TRUSTEE’S NOTICE OF SALE
WHEREAS, Jeffery L. Smith and Timothy E. Petraroi, executed, acknowledged and delivered to Lawrence F. Counts, Trustee a certain Deed of Trust dated November 13, 2015, securing Audry Forsyth and husband, Ralph Forsyth found of record on Roll 886, Image1737, in the Register’s Office for Washington County, Tennessee, to secure a certain indebtedness fully described therein; and
WHEREAS, the owner and holder of the secured indebtedness and beneficial interest of the Deed of Trust is Audry Forsyth and husband, Ralph Forsyth; and
WHEREAS, default has been made in the payment of said indebtedness and the same has become due and payable, and the owner and holder of said indebtedness has instructed the said Trustee to foreclose said Deed of Trust and to advertise and sell the property herein described upon the terms and conditions as set forth in said Deed of Trust; and
NOW, THEREFORE, notice is hereby given that I will, on the 4th day April, 2017, at 11:15 A.M., prevailing standard time, at the front courthouse door of the Old Washington County, Tennessee, Courthouse located at 100 E. Main Street, Jonesborough, Tennessee 37659, sell at public auction, for cash, to the highest bidder (10% deposit due on day of sale, balance due in full at closing within 15 days from day of sale, purchaser shall pay all recording fees and taxes, examination title, settlement fees, and all cost of conveyance including preparation of a substitute trustee’s deed), and in bar of the equitable and statutory rights of redemption, and subject to any and all taxes and any and all assessments, any and all prior encumbrances, if any, leases, easements, and all other matters which take priority over the Deed of Trust under which this foreclosure sale is conducted. Any notices required to any governmental agency is being given to them and the sale will be subject to the governmental entities right to redeem the property, all as required by 26 USC 7425 T.C.A 67-1-1433 and 28 USC 2410 (C). The notice requirements of T.C.A. 35-5-101 ET SEQ. 17 have been met. The following described real estate as set forth in said Deed of Trust, to-wit:
Situate, lying and being in the 16th Civil District of Washington County, Tennessee, and more particularly described as follows, to-wit:
BEING all of Lots 1, 2, 3, 4, 5 and 6 of the Subdivision for Audrey Forsythe, as shown by map or plat of record in Plat Book 20, Page 890, in the Register’s Office for Washington County, Tennessee, to which reference is here made.
AND BEING the same property conveyed to Jeffery L. Smith and Timothy E. Petraroi by Deed dated the 13th day of November, 2015 from Audry Forsythe, of record in Roll 886, Image 1734, in the Register’s Office for Washington County, Tennessee.

The sale will be made as Trustee only, without covenants of seizen or warranties of title, subject to unpaid taxes and assessments owing on the property, and subject to all liens, encumbrances, easements, right-of-way, set-back lines, restrictions, and covenants affecting the subject property having priority over the lien created by the subject deed of trust.
The proceeds derived from the sale of said property will be applied toward payment of the indebtedness, including interest and attorney’s fees secured by said Deed of Trust, and the balance, if any, to be paid to the parties legally entitled. The sale held pursuant to this notice maybe rescinded at the Trustee’s option at any time.
