WHEREAS, by Deed of Trust dated the 12th day of April, 2012, recorded in Roll 754 Image 1119, in the Register’s Office for Washington County, Tennessee at Jonesborough, Travis Chatman and wife, Noemi A. Chatman, and Beverly June Chatman (the “Grantor”) conveyed to James W. Hickerson, Trustee, the hereinafter described real estate to secure the payment of Grantor’s promissory note and all other obligations described therein owing to Andrew Johnson Bank (the “Beneficiary”); and

WHEREAS, on the 12th day of September, 2014, Michael J. Hickie of Washington County, Tennessee was appointed and designated Substitute Trustee by the Beneficiary pursuant to the terms and conditions of said Deed of Trust, said appointment of Substitute Trustee being recorded in the aforesaid Register’s Office in Roll 847 Image 2078; and

WHEREAS, default has been made in the payment of said indebtedness, now past due, the entire balance of which having been declared due and payable in accordance with the terms of said Note and Deed of Trust, and the owner and holder of said Note has directed me, the undersigned Substitute Trustee, to foreclose said Deed of Trust in accordance with the terms thereof and to sell said real estate;

NOW, THEREFORE, by virtue of the authority vested in me by said Deed of Trust, I will on the 18th day of November, 2014, conduct the sale at the front Courthouse door of the old courthouse at 110 Main Street in Jonesborough, Washington County, Tennessee at the hour of 1:45 o’clock p.m. local time, and I will then offer to sell at public auction to the last, highest and best bidder for cash on such terms as announced at the sale free from all equitable rights of redemption, statutory rights of redemption, homestead, dower, and all other exemptions and redemptive rights of every kind, all of which were expressly waived and surrendered by the terms of said Deed of Trust, subject however, to such prior encumbrances, easements, leases, objections, conditions, restrictions, out-conveyances, ad valorem taxes (current and delinquent), and priority tax liens (if any) as may appear of record, including but not limited to the ones set out herein, the following described real property:

Situate, lying and being in the 7th Civil District of Washington County, Tennessee, more particularly described as follows:

BEGINNING at an iron point pin 25’ in a southeasterly direction from the central line of Fordtown Road property to be conveyed to Larry Lee Chatman; thence with said road, North 62 degrees 43 minutes 17 seconds East, 127.7 feet; thence North 59 degrees 28 minutes 22 seconds East, 30.99 feet corner to property of Jerry Russell Chatman; thence South 37 degrees 30 minutes 24 seconds East, 221.51 feet thence North 57 degrees 22 minutes 17 seconds East, 146.09 feet thence South 37 degrees 21 minutes 49 seconds East, 785.98 feet corner to property of Robert Howard (Deed Book 638 Page 402); thence South 57 degrees 11 minutes 37 seconds West, 103.87 feet to a set rock; thence South 55 degrees 28 minutes 18 seconds West, 120.93 feet corner to Larry Lee Chatman; thence North 37 degrees 40 minutes 07 seconds West, 790.69 feet thence South 57 degrees 22 minutes 17 seconds West, 73.07 feet; thence North 37 degrees 40 minutes 37 seconds West, 234.66 feet to the point of BEGINNING, containing 4.907 acres, more or less, according to a survey prepared by Rowland C. Barker, TRLS 642.

BEING the same property conveyed to Travis Chatman, Larry Lee Chatman and Beverly June Chatman by Quitclaim Deed dated March 29, 2004 from Rex Whaley Chatman and wife, Janet Leigh Chatman, of record in Roll 383 Image 1017, in the Register’s Office for Washington County, Tennessee at Jonesborough, to which reference is here made. Larry Lee Chatman, the husband of Beverly June Chatman is now deceased, date of death being January 31, 2012.

Said property bears the street address of Fordtown Road, Jonesborough, TN 37659.

The property will be sold AS IS WHERE IS with no warranties or representations of any kind, express or implied, and including any warranty for a particular purpose.

The aforesaid sale may be postponed to a later date by oral announcement at the time and place of the published sale or canceled without further written notice or publication.

The undersigned reserves the right take or accept the next highest or best bid at such sale should the last and highest bidder fail or refuse to comply with the terms of sale for any reason. In such event, the undersigned shall also reserve the right to reopen the bidding or republish and sell said real property at the option of the undersigned. The Beneficiary may bid on said real property.

The Substitute Trustee reserves the right to conduct the sale by or through his agents or attorneys acting in his place or stead, including the use of an auctioneer.

There are no liens of record or claimed liens by the United States or the State of Tennessee.
