SUBSTITUTE TRUSTEE’S NOTICE OF SALE

WHEREAS, by Deed of Trust dated the 1st day of October, 2007, recorded in Roll 574 Image 1968, in the Register’s Office for Washington County, Tennessee at Jonesborough, Robert Wayne Brewer and Barbara Jean London (the “Grantor(s)”) conveyed to James T. Milliken, Trustee, the hereinafter described real estate to secure the payment of Grantor’s promissory note and all other obligations described therein owing to Donald F. Hunter, IRA, First Bank and Trust Company, Custodian (the “Beneficiary”); and

WHEREAS, on the 13th day of May, 2014, Michael J. Hickie of Washington County, Tennessee was appointed and designated Substitute Trustee by the Beneficiary pursuant to the terms and condition of said Deed of Trust, said appointment of Substitute Trustee being recorded in the aforesaid Register’s Office in Roll 836 Image 487: and

WHEREAS, default has been made in the payment of said indebtedness, now past due, the entire balance of which having been declared due and payable in accordance with the terms of said Note and Deed of Trust, and the owner and holder of said Note has directed me, the undersigned Substitute Trustee, to foreclose said Deed of Trust in accordance with the terms thereof and to sell said real estate;

NOW, THEREFORE, by virtue of the authority vested in me by said Deed of Trust, I will on the 8th day of July, 2014, conduct the sale at the front Courthouse door of the old courthouse at 110 Main Street in Jonesborough, Washington County, Tennessee at the hour of 1:30 o’clock p.m. local time, and I will then offer to sell at public auction to the last, highest and best bidder for cash on such terms as announced at the sale free from all equitable rights of redemption, statutory rights of redemption, homestead, dower, and all other exemptions and redemptive rights of every kind, all of which were expressly waived and surrendered by the terms  of said Deed of Trust, subject however, to such prior encumbrances, easements, leases, objections, conditions, restrictions, out-conveyances, ad valorem taxes (current and delinquent), and priority tax liens (if any) as may appear of record, including but not limited to the ones set out herein, the following described real property:

To find the point of BEGINNING, being at an iron pin situated in the southern right of way of Spruce Street and corner to Taylor; thence running with Spruce Street, North 49 degrees 19 minutes 21 seconds East, 122.45 feet to an iron pin; thence South 40 degrees 40 minutes 05 seconds East, 150.60 feet to an iron pin, corner to Jones; thence running with Jones, South 49 degrees 38 minutes 07 seconds West, 37.94 feet to an iron pin, the point of BEGINNING; thence a new line South 49 degrees 38 minutes 07 seconds West, 84.57 feet to an iron pin, corner to Taylor; thence South 49 degrees 18 minutes 38 seconds West, 132.97 feet to an iron pin; thence South 42 degrees 10 minutes 31 seconds East, 10.18 feet to a concrete monument; thence South 48 degrees 09 minutes 15 seconds West, 92.71 feet to an iron pin, corner to Whaley; thence with Whaley, South 43 degrees 17 minutes 06 seconds East, 137.61 feet to a concrete monument in the northwesterly margin of St. Louis Street; thence with said street, North 49 degrees 07 minutes 58 seconds East, 85.30 feet to an iron pin, the northerly terminus of Tullioka Street; thence with said street, South 40 degrees 21 minutes 54 seconds East, 50.00 feet to an iron pin, corner to Miller; thence with Miller, North 49 degrees 07 minutes 58 seconds East, 112.38 feet to an iron pin; thence North 35 degrees 01 minute 55 seconds West, 24.13 feet to an iron pin; thence North 50 degrees 38 minutes 10 seconds East, 74.64 feet to an iron pin in the westerly terminus of St. Louis Street; thence with said street, in part, and Jones, in part, North 31 degrees 13 minutes 45 seconds West, 178.56 feet to the point of BEGINNING, containing 1.16 acres, more or less, and designated as Lot 1 on a survey by Gary C. This conveyance is made subject to all valid restrictive covenants and easements, if any, of record, or which may be apparent from an inspection of the premises.

BEING the same property conveyed to Robert Wayne Brewer and Barbara Jean London dated the 1st day of October, 2007, from Donald F. Hunter, IRA, First Bank and Trust Company Custodian, recorded in the Register’s Office for Washington County, Tennessee at Jonesborough, in Roll 574 Image 1968, to which reference is here made.

Said property bears the street address of 1407 St. Louis Street, Johnson City, Tennessee 37601.

The property will be sold AS IS WHERE IS with no warranties or representations of any kind, express or implied, and including any warranty for a particular purpose.

The aforesaid sale may be postponed to a later date by oral announcement at the time and place of the published sale or canceled without further written notice or publication.

The undersigned reserves the right take or accept the next highest or best bid at such sale should the last and highest bidder fail or refuse to comply with the terms of sale for any reason.  In such event, the undersigned shall also reserve the right to reopen the bidding or republish and sell said real property at the option of the undersigned.  The Beneficiary may bid on said real property.

The Substitute Trustee reserves the right to conduct the sale by or through his agents or attorneys acting in his place or stead, including the use of an auctioneer.

There are no liens of record or claimed liens by the United States or the State of Tennessee.

Denny, Trustee, the hereinafter described real estate to secure the payment of Grantor’s promissory note and all other obligations described therein owing to First Bank and Trust Company, Custodian for the benefit of Mark Sellier S/D IRA (the “Beneficiary”); and

WHEREAS, on the 24th day of May, 2014, Michael J. Hickie of Washington County, Tennessee was appointed and designated Substitute Trustee by the Beneficiary pursuant to the terms and condition of said Deed of Trust, said appointment of Substitute Trustee being recorded in the aforesaid Register’s Office in Roll 836 Image 2490: and

• The Industrial Development Board of the City of Johnson City will hold a special called

meeting on Thursday, June 26, 2014 at 12:00 p.m. for the following purposes:

1) Consider creation of a By-Laws committee

2) Consider other matters as may properly come before the meeting
