SUBSTITUTE TRUSTEE’S NOTICE OF SALE

WHEREAS, by Deed of Trust dated the 11th day of October, 2007, recorded in Roll 576 Image 805, in the Register’s Office for Washington County, Tennessee at Jonesborough, Gary Wayne Shadden (the “Grantor”) conveyed to Gene H. Tunnell, Trustee, the hereinafter described real estate to secure the payment of Grantor’s promissory note and all other obligations described therein owing to Johnny W. Shadden (the “Beneficiary”); and

WHEREAS, on the 22nd day of October, 2014, Jack R. Carrier of Washington County, Tennessee was appointed and designated Substitute Trustee by the Beneficiary pursuant to the terms and conditions of said Deed of Trust, said appointment of Substitute Trustee being recorded in the aforesaid Register’s Office in Roll 851 Image 1326; and

WHEREAS, default has been made in the payment of said indebtedness, now past due, the entire balance of which having been declared due and payable in accordance with the terms of said Note and Deed of Trust, and the owner and holder of said Note has directed me, the undersigned Substitute Trustee, to foreclose said Deed of Trust in accordance with the terms thereof and to sell said real estate;

NOW, THEREFORE, by virtue of the authority vested in me by said Deed of Trust, I will on the 9th day of December, 2014, conduct the sale at the front Courthouse door of the old courthouse at 110 Main Street in Jonesborough, Washington County, Tennessee at the hour of 11:10 o’clock a.m. local time, and I will then offer to sell at public auction to the last, highest and best bidder for cash on such terms as announced at the sale free from all equitable rights of redemption, statutory rights of redemption, homestead, dower, and all other exemptions and redemptive rights of every kind, all of which were expressly waived and surrendered by the terms of said Deed of Trust, subject however, to such prior encumbrances, easements, leases, objections, conditions, restrictions, out-conveyances, ad valorem taxes (current and delinquent), and priority tax liens (if any) as may appear of record, including but not limited to the ones set out herein, the following described real property:

Situate, lying and being in the 14th Civil District of Washington County, Tennessee, more particularly described as follows:

CONTROL MAP 19J, GROUP C, PARCEL 049.00

BEGINNING at an iron pin on the northerly side of the 30’ County Road, corner to Walker; thence with the line of Walker, North 11 degrees 46 minutes East, 234.17 feet to an iron pin; thence North 78 degrees 00 minutes West, 131.90 feet to the stake; thence South 13 degrees 10 minutes West, 212.56 feet to a stake on the northerly side of said 30’ County Road; thence with the northerly side of said County Road, South 69 degrees 02 minutes East, 138.9 feet to the point of beginning, and containing .7 acres, more or less, together with a mobile home contained thereon.

BEING the same property as that conveyed to Gary Wayne Shadden by deed dated October 11, 1983 from George M. Haws, Jr., and wife, Elsie N. Haws, of record in the Register’s Office for Washington County, Tennessee at Jonesborough, in Deed Book 591 Page 371, to which reference is hereby expressly made.

Said property bears the street address of 310 SAM JENKINS ROAD,
GRAY, TENNESSEE 37615.
The property will be sold AS IS WHERE IS with no warranties or representations of any kind, express or implied, and including any warranty for a particular purpose.

The aforesaid sale may be postponed to a later date by oral announcement at the time and place of the published sale or canceled without further written notice or publication.

The undersigned reserves the right take or accept the next highest or best bid at such sale should the last and highest bidder fail or refuse to comply with the terms of sale for any reason. In such event, the undersigned shall also reserve the right to reopen the bidding or republish and sell said real property at the option of the undersigned. The Beneficiary may bid on said real property.

The Substitute Trustee reserves the right to conduct the sale by or through his agents or attorneys acting in his place or stead, including the use of an auctioneer.

There are no liens of record or claimed liens by the United States or the State of Tennessee.

Carrier, Trustee, the hereinafter described real estate to secure the payment of Grantor’s promissory note and all other obligations described therein owing to Johnny W. Shadden and Judy H. Shadden (the “Beneficiaries”); and

WHEREAS, default has been made in the payment of said indebtedness, now past due, the entire balance of which having been declared due and payable in accordance with the terms of said Note and Deed of Trust, and the owner and holder of said Note has directed me, the undersigned Trustee, to foreclose said Deed of Trust in accordance with the terms thereof and to sell said real estate;

D. Roberts (Roll 365 Image 2229); thence with the line of W. D. Roberts, North 30 degrees 00 minutes 00 seconds West, a distance of 107.63 feet to a point; thence with the boundary of W. D. Roberts, North 61 degrees 56 minutes 00 seconds East, a distance of 186.25 feet to a point in the southwestern boundary of Shadden Road; thence with the boundary of said road, South 24 degrees 03 minutes 00 seconds East, a distance of 116.64 feet to the point of BEGINNING, containing .464 acre, more or less, according to a plat of survey dated July 28, 2008 by William Michael Glass, Surveyor, License No. 927, to which reference is here made.

Said property bears the street address of 1193 SHADDEN ROAD, GRAY, TENNESSEE 37615.
