TO THE VOTERS OF THE City of JOHNSON CITY, WASHINGTON COUNTY, TN: You are hereby notified that by call of the following petition signed by ten percent (10%) or more of the registered voters in town casting a ballot for governor in the last gubernatorial election, a referendum for Wine at Retail Food Stores shall be conducted:

We, the registered voters of the City of Johnson City, do hereby request the holding of a local option election to authorize wine at retail food stores in the City of Johnson City as provided by law.

ORDINANCE NO. 4547-14

AN ORDINANCE TO CALL FOR A REFERENDUM TO AMEND THE CHARTER OF THE CITY OF JOHNSON CITY BY DELETING CERTAIN SECTIONS THEREFROM IN THEIR ENTIRETY AND TO ENACT AND SUBSTITIUTE IN LIEU OF CERTAIN DELETED SECTIONS NEW SECTIONS AND TO SUBMIT SAID AMENDMENT TO THE QUALIFIED VOTERS OF THE CITY OF JOHNSON CITY, TENNESSEE IN THE NEXT GENERAL ELECTION TO BE HELD ON THE FIRST TUESDAY IN NOVEMBER, 2014, AND TO REQUEST THE ELECTION COMMISSIONERS OF WASHINGTON, CARTER, AND SULLIVAN COUNTIES, TENNESSEE TO PLACE THE PROPOSED AMENDMENT UPON THE OFFICIAL BALLOT.

BE IT ORDAINED BY THE CITY OF JOHNSON CITY as follows:

SECTION 1. That the Charter of the City of Johnson City is amended by deleting the present Sections 11, 12, and 126 therein, which new sections shall provide as follows:
Section 11. When Terms of Commissioners Begin.
That the terms of all City Commissioners shall begin on the first Monday in December following the date of their election.

Section 12. Election of Commissioners Generally.

Board of Commission members elected in April of 2011, whose terms expire in 2015, shall have their terms of office extended until the first Monday in December of 2016. Board of Commission members elected in April of 2013, whose terms expire in 2017, shall have their terms of office extended until the first Monday in December of 2018. A municipal election shall be held in said City to coincide with the general state election held on the first Tuesday after the first Monday in November of each succeeding two years, beginning with 2016 for the election of Commissioners who shall succeed the Commissioners holding office at the time of the adoption of this section of the Charter whose terms shall expire when the certified candidates are sworn into office on the first Monday in December following the general state election held in November. After the terms of office are extended, the terms of office for Board of Commission members shall be for four (4) years and until their successors are elected, certified, and sworn into office, with said terms of such members to begin on the first Monday in December after the general state election held in November. There shall be five (5) members of the Board of Commissioners.

Section 126. Election of Members: Terms

The members of the Board of Education elected in April of 2011, whose terms expire in 2015, shall have their terms of office extended until the first Monday in December of 2016. The members of the Board of Education elected in April of 2013, whose terms expire in 2017, shall have their terms of office extended until the first Monday in December of 2018. A municipal election shall be held in said City to coincide with the general state election held on the first Tuesday after the first Monday in November of each succeeding two years, beginning with 2016 for the election of the Board of Education members who shall succeed the Board of Education members holding office at the time of the adoption of this section of the Charter whose terms shall expire when the certified candidates are sworn into office on the first Monday in December following the general state election held in November. After the terms of office are extended, the terms of office for the members of the Board of Education shall be for four (4) years and until their successors are elected, certified, and sworn into office, with said terms of such members to begin on the first Monday in December after the general state election held in November.

SECTION II. BE IT FURTHER ORDAINED that the foregoing amendments to the Charter of the City of Johnson City, Tennessee shall be submitted to the qualified voters of the City of Johnson City in the next general election to be held on the first Tuesday in November, 2014.

ORDINANCE NO. 4557-14

AN ORDINANCE TO CALL FOR A REFERENDUM TO AMEND THE CHARTER OF THE CITY OF JOHNSON CITY BY DELETING A CERTAIN SECTION THEREFROM IN ITS ENTIRETY AND TO ENANCT AND SUBSTITUTE IN LIEU OF THAT DELETED SECTION A NEW SECTION AND TO SUBMIT SAID AMENDMENT TO THE QUALIFIED VOTERS OF THE CITY OF JOHNSON CITY, TENNESSEE IN THE NEXT GENERAL ELECTION TO BE HELD ON THE FIRST
TUESDAY IN NOVEMBER, 2014, AND TO REQUEST THE ELECTION COMMISSIONERS OF WASHINGTON, CARTER, AND SULLIVAN COUNTIES, TENNESSEE TO PLACE THE PROPOSED AMENDMENT UPON THE OFFICIAL BALLOT.

BE IT ORDAINED BY THE CITY OF JOHNSON CITY as follows:

SECTION 1. That the Charter of the City of Johnson City is amended by deleting the present Section 23 and substituting therein a new section, which shall provide as follows:

SECTION 23. FILLING VACANCIES.

That when any vacancy in the Board of Commissioners shall occur, caused by death, resignation, removal from the city, or otherwise, the Board of Commissioners shall have the power to provide an incumbent for said office until the next regular city election coming thereafter, at which time the qualified voters of the City of Johnson City shall fill said office for the unexpired term or for a new term, as the case may be.

SECTION II. Be it further ordained that the foregoing amendment to the Charter of the City of Johnson City, Tennessee shall be submitted to the qualified voters of the City of Johnson City in the next general election to be held on the first Tuesday in November, 2014.

SECTION III. Be it further ordained that the Election Commissioners of Washington, Carter, and Sullivan Counties, Tennessee are hereby requested to place the foregoing proposed amendment on the official ballot, with the question to be proposed in substantially the following words:

“Shall the Charter of the City of Johnson City be amended so that when any vacancy in the Board of Commissioners shall occur, caused by death, resignation, removal from the city, or otherwise, the Board of Commissioners shall have the power to provide an incumbent for said office until the next regular city election coming thereafter, at which time the qualified voters of the City of Johnson City shall fill said office for the unexpired term or for a new term, as the case may be?”

SECTION IV. Be it further ordained that all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed.

SECTION V. Be it further ordained that this ordinance shall take effect upon third and final reading and publication, as required by law, the public welfare requiring it.
